TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference.

These Terms apply to all HALP platforms including www.halp.com.au and www.boutiquedevelopments.com.au. By using our services you acknowledge you have read and agree to these Terms and our Privacy Policy, represent that you are at least 18 years of age, and have the authority to enter into this agreement.

We reserve the right to modify these Terms at any time. Material changes will be prominently displayed and registered users will be notified via email.

2. Description of Services

HALP operates specialized property discovery and business directory platforms — house and land package listings, off-the-plan project information, new development details, school zone integration, mortgage broker connections, and business directory subscriptions.

HALP is an information and advertising platform. We facilitate connections between property seekers and property providers — we are not a real estate agent, developer, builder, or financial advisor. When you submit a property listing inquiry, your information goes directly to the listing agent, developer, or builder; HALP does not store, read, or access these inquiries.

Services are provided "as is" and "as available". We may modify, suspend, or discontinue services at any time. Our platform is delivered through Amazon Web Services, Stripe, Pipedrive, ActiveCampaign, Google Workspace, and Zapier.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate information, maintain the confidentiality of your credentials, be at least 18 years of age, and only create one account per person. Business accounts require a valid ABN or ACN.

4. User Conduct and Prohibited Activities

You must comply with all applicable laws, use services only for lawful purposes, and act in good faith. You must not misuse the platform (bots, scraping, unauthorized access), post harmful content, engage in illegal activities, harass other users, or engage in commercial misuse (reselling our services, aggregating listings for competing platforms).

Violations may result in immediate account suspension, content removal, legal action, and permanent bans.

5. Property Listings and Information

Property listings and information are provided and owned by property developers, builders, real estate agents, and third-party data providers. HALP does not own or verify all listings. Property information may change without notice — always verify critical information directly with the property provider.

School Zone Information

School zone data is sourced from government databases and provided for reference only. School zone boundaries change regularly. Always verify catchments directly with the relevant education department and individual schools.

6. Business Directory Listings

To advertise you must hold a valid ABN or ACN, be a legitimate operating business, and comply with all applicable business and advertising laws. Listings must be accurate and comply with Australian Consumer Law. Free listings receive basic presence; premium subscriptions require monthly or annual payment and auto-renew unless cancelled.

7. Payment Terms

Pricing is displayed on our website or in the applicable Listing Agreement, in Australian Dollars, exclusive of GST unless otherwise stated. Payments are processed via Stripe (PCI-DSS Level 1 certified). Subscriptions auto-renew unless cancelled. Cancellation takes effect at the end of the current billing period with no partial refunds. Pro-rata refunds apply for technical issues preventing service access, processed within 14 business days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us — trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design, software, text, graphics, images, and data compilations. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax, or real estate advice. Our calculators and tools provide estimates only. Always consult qualified professionals. We do not guarantee continuous, uninterrupted access, error-free operation, or absence of viruses.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential, or incidental damages. Where liability cannot be excluded, our total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law.

You agree to indemnify HALP from any claims arising from your breach of these Terms, violation of any law, use of our services, or content you submit.

11. Dispute Resolution

Before initiating legal proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the NSW courts. Optional arbitration in Sydney is available under ADRA rules. You waive the right to participate in class actions to the extent permitted by law.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is found invalid, remaining provisions continue in force. You may not assign these Terms without our written consent.

13. Special Terms for Specific Services

Mortgage calculators provide estimates only. School zone data is provided "as is" without warranty of accuracy. Property alerts require consent. When we connect you with mortgage brokers we may receive a referral fee — brokers are independent third parties.
